ClearSight is provided "as is" and "as available," without any warranties of any kind, express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that:

• Access to the platform will be uninterrupted, timely, secure, or error-free.
• The results obtained from using the platform will be accurate or reliable.
• Any errors in the platform will be corrected.

3. Limitation of Liability

3.1 Indirect Damages

In no event shall ClearSight, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

ClearSight's total liability to you for all claims arising out of or related to the use of the platform shall in no event exceed the amount you have paid, if any, to use our platform in the twelve (12) months preceding the event giving rise to the liability.

You agree to defend, indemnify, and hold ClearSight, its affiliates, directors, employees, and agents harmless from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of the platform.
• Your violation of any term of these Disclaimers.
• Your violation of any third-party right, including without limitation any intellectual property right or privacy right.
